Terms of Service

1. Acceptance of terms

These Terms of Service (the "Terms") govern your use of the Norbo mobile application (the "App" or the "Service"), built and operated by Marius Trica, an individual indie developer based in Italy (referred to in this document as "I" or "me").

By creating an account or using the App, you confirm that you have read, understood, and accepted these Terms in full, together with the Privacy Policy and the Tools and Calculators Disclaimer, which are part of this agreement.

If you do not agree, even in part, please do not use the App.

2. About the service

Norbo is a mobile application for managing the lives of domestic and non-domestic animals. It lets you, among other things:

• Record information about your animals (dogs, cats, fish, birds, reptiles, small mammals, amphibians, invertebrates, equines, farm animals, and other categories);
• Keep a timeline of health and life events (vaccinations, visits, weight, environmental parameters, photos);
• Set reminders for health due dates, maintenance tasks, document renewals, and milestones;
• Keep a photo album and a record of your expenses;
• Browse general care information by animal category;
• Use support tools and calculators (water intake, caloric needs, ideal weight, Body Condition Score, food and plant toxicity, and others).

Norbo is a personal organisation tool. It is not a veterinary service or a substitute for one. For use of the Tools and Calculators, the dedicated Disclaimer applies — please read it.

3. Account and registration

To use the App you need to create an account by providing a valid email address and a password, or by signing in with Google, Facebook, or Microsoft, or via a one-time code sent by email. To register, you must:

• Be at least 16 years old (or the minimum age required for data-protection consent in your country);
• Provide accurate information and keep it up to date;
• Keep your credentials safe and not share them with anyone else.

You are solely responsible for any activity carried out through your account. If you notice unauthorised access or suspicious activity, please contact me immediately at tricabit@gmail.com.

4. Acceptable use

You agree to use the App lawfully, fairly, and in accordance with these Terms. In particular, you agree not to:

• Use the App for unlawful or fraudulent purposes, or in ways that infringe third parties' rights;
• Upload unlawful, defamatory, obscene, violent, offensive, or copyrighted content where you are not authorised to do so;
• Attempt to access Norbo's systems or other users' data without authorisation, or interfere with the service's operation;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent allowed by law;
• Use bots, scrapers, or automated tools to extract data or overload the infrastructure;
• Resell, sublicense, or redistribute the App or its features;
• Use the App for commercial purposes not permitted under these Terms (for example, as a management tool for a professional veterinary practice, breeder, or pet business, without a specific agreement).

If you violate these rules, I may suspend or delete your account, without prejudice to any legal action to protect my rights or those of other users.

5. Your content

Everything you put into the App — your pet data, photos, events, expenses, notes — stays yours. You retain all rights to your content.

For the sole purpose of providing the service (storage, sync across devices, data export, backups), you grant me a limited, non-exclusive, royalty-free, worldwide, revocable licence to store and process that content. This licence ends automatically when you delete the content or your account.

I will never use your content for purposes other than running the service. Specifically: no commercial use, no advertising, no training of machine learning models, no sharing with third parties.

6. Tools, calculators, and health disclaimer

The App includes tools and calculators (water intake, caloric needs, ideal weight estimator, Body Condition Score, food and plant toxicity checker, and others) designed as an organisational and informational aid. These Tools:

• Provide indicative estimates based on average reference parameters for the animal's species or category;
• Do not constitute veterinary or medical advice of any kind;
• Are not a diagnosis, prognosis, or therapeutic recommendation;
• Are not a substitute for the clinical judgement of a qualified veterinarian.

Results depend on the data you enter and do not account for pre-existing health conditions, illnesses, ongoing therapies, or significant individual variation in your animal. Use them as a starting point for a conversation with your vet, not as a definitive answer.

The App may also include general care information by animal category. This information is equally provided for informational purposes only and does not replace the advice of a qualified veterinarian.

In an emergency, if your animal shows acute symptoms, unusual behaviour, or signs of distress, do not use the Tools: contact your vet or an emergency veterinary service immediately.

Likewise, reminders are a memory aid, not a guarantee. They don't relieve you of the responsibility to meet health, legal, or care-related due dates on time.

I accept no responsibility for decisions made on the basis of information or results shown in the App.

7. Exotic animals and legality

Norbo supports recording animals from many categories, including reptiles, amphibians, birds, invertebrates, and fish. The fact that you can record an animal in the App is not a statement that keeping that animal is legal in your jurisdiction.

You are solely responsible for checking and complying with the laws that apply to keeping, acquiring, or moving any animal you own. In particular, keep in mind:

• The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), which governs international trade in protected species;
• EC Regulation No. 338/97 on the protection of species of wild fauna and flora through controls on trade;
• For users in Italy: Law No. 157 of 11 February 1992 on the protection of homoeothermic wildlife and hunting;
• Any additional national, regional, or local laws that may apply to you.

Norbo in no way encourages keeping animals in violation of applicable law and accepts no responsibility for any unlawful use of the App.

8. Intellectual property

The App, the name "Norbo", the logo, the design, the editorial content (care information), trademarks, and every other distinctive element are owned by me (or by their respective owners, where applicable) and are protected by copyright, trademark, and intellectual property laws.

I grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for the purposes described in these Terms. No other rights are granted, expressly or by implication.

Some components of the App may be released under open-source licences; in that case, use of those components is governed by their respective licences.

9. Suspension and deletion

Deletion by you

You can delete your account at any time, with no notice and no cost, using the "Delete account" function in the App settings. When you do:

• I will permanently delete your personal data within 30 days;
• Any data strictly required to fulfil legal obligations will be retained for the period required by law, in minimised form.

Suspension or deletion by me

I may suspend or delete your account, with prior notice where possible, in the following cases:

• Serious or repeated breach of these Terms;
• Use of the App for unlawful purposes or in ways that infringe third parties' rights;
• Conduct that puts the security of the infrastructure or other users at risk;
• Discontinuation of the Service (see next section).

In case of suspension or deletion, you will still be able to export your data, except where this is prevented by a legal authority's order.

10. Service availability

I aim to provide the Service with all reasonable care, but I cannot guarantee that the App will always be available, uninterrupted, or free from errors or defects. In particular:

• There may be interruptions for scheduled maintenance, updates, or technical reasons;
• The Service depends on third-party providers (cloud, push notifications, app stores) whose downtime may affect availability;
• Features may be added, changed, or removed over time, while keeping the core of the Service in place.

I may discontinue the Service with reasonable notice (at least 60 days, except for cases of force majeure), giving you the chance to export your data before it shuts down.

11. Limitation of liability

The App is provided "as is" and "as available", to the maximum extent permitted by applicable law.

To the maximum extent permitted by law, I will not be liable for:

• Decisions you make based on information or results shown in the App, in particular care information and Tool results;
• Harm to the health or wellbeing of any animal resulting from using the App as a substitute for veterinary advice;
• A reminder failing to fire due to your device settings, lack of connectivity, OS issues, or push notification service outages;
• Data loss caused by factors outside my control (e.g. accidental deletion by you, device failure on your end);
• Indirect or consequential damages, lost profits, or lost opportunities.

Nothing in these Terms limits my liability for wilful misconduct, gross negligence, or any other liability that cannot be excluded under applicable law — in particular, statutory consumer protections.

12. Changes to these terms

I may update these Terms when the service evolves, when applicable laws change, or when my operational practices change.

The current version will always be published at this address, with the date of the last update clearly shown. For material changes, I will let you know in advance through an in-app notification or by email to the address linked to your account. If you don't agree with the changes, you can delete your account before they take effect. Continuing to use the App after the changes take effect means you accept the new Terms.

13. Governing law

These Terms are governed by Italian law.

For any dispute arising out of or connected to your use of the App, the courts of Italy will have jurisdiction. This is without prejudice to your statutory rights as a consumer, including the mandatory consumer forum protections under Italian and EU consumer law: if you qualify as a consumer, you may bring or be sued in the court of your place of residence.
